ELIGIBILITY:
Open only to legal United States residents and legal residents of Canada, who are at least eighteen (18) years of age and the age of majority in their state/province of residence (21 in Mississippi, 19 in Alabama and Nebraska and the following provinces/territories British Columbia, New Brunswick, Newfoundland, Northwest Territories, Nova Scotia, Nunavut, and Yukon, and 18 in all other states/provinces/territories).  Employees, officers and directors of Sponsor, its parent, subsidiaries, affiliates, distributors, agents, partners, sales representatives, advertising and promotion agencies (collectively, the “Sweepstakes Entities”) and the Immediate Family Members, and/or Household Members of each are ineligible to participate in the Sweepstakes or win a Prize and are not eligible to participate. For purposes of the Sweepstakes, "Household Members" means those people who share the same residence at least three months a year, whether or not related; "Immediate Family Members" means parents, stepparents, legal guardians, children, step-children, siblings, step-siblings, or spouses, regardless of where they live.  Sweepstakes is void where prohibited by law.

HOW TO ENTER:
a) During the Sweepstakes Period, eligible entrants will automatically receive one (1) entry for every piece of Effy Jewelry purchased and one (1) additional entry for every $1,000 spent at Effyjewelry.com.  For example: if a person spends $2,000 on a necklace, they will receive three (3) entries; one (1) for the piece of jewelry and two (2) for the 2 x $1,000 spent or if a person spends $2,000 on a necklace and ring, they will receive four (4) entries; two (2) for the pieces of jewelry and two (2) for the 2 x $1,000 spent.

b) NO PURCHASE NECESSARY. To enter without making a purchase (the “AMOE”), click here: https://easyscan.scainteractive.com/easyscan/default/enter?amoe_key=ix1fzm61pc  (the “AMOE Website”) and complete the Entry Request (“Request”) form in its entirety with your full name, email address, complete mailing address (including city, state and zip code), date of birth and telephone number.  Once the Request form is completed, follow the instructions to print out the form and affix the barcode to a post card with first class postage.  For U.S. entrants, mail the Request to: Enter the Effy eCommerce Sweepstakes, 3030 LBJ Freeway, Suite 300, Dallas TX 75234. For Canadian entrants, mail the Request to: Enter the Effy eCommerce Sweepstakes, P.O. Box 43029, RPO Deer Valley, Calgary, Alberta T2J 7A7.  All Requests must be mailed. Limit one barcode per postcard.  All Requests must be received by January 8, 2025. One (1) mail-in entry will be equal to four (4) entries into the Sweepstakes.  No copies, facsimiles or mechanical reproductions will be accepted. Sponsor assumes no responsibility for lost, late, incomplete, stolen, misdirected, illegible or postage due entries or mail. 

The Sweepstakes Entities assume no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of entries.

WINNER SELECTION AND NOTIFICATION:
On January 30, 2025 at 12:00 p.m. CST in Dallas, TX one (1) potential prize winner will be randomly selected from all eligible entries received in accordance with the deadlines stated in these Official Rules.  The potential winner will be notified by telephone and/or e-mail, using contact information associated with their entry. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason. NOTE: Canadian residents must first correctly answer without assistance of any kind, whether mechanical or otherwise, a mathematical skill testing question prior to receiving a Prize.  If, despite reasonable efforts, a potential winner does not respond within seventy-two (72) hours of the first notification attempt, or if the Prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit their Prize and an alternate winner may be selected.  Sponsor, in its sole discretion, will attempt to contact up to three (3) potential winners of a Prize in accordance with the above procedure, after which the Prize in question may go unawarded if it remains unclaimed.  If any potential Prize winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines the Prize for any reason prior to award, such potential Prize winner will be disqualified and an alternate Prize winner may be selected.  The odds of winning depend on the total number of eligible entries received in accordance with the deadlines stated herein.

PRIZE:
One (1) Prize is available.  The Prize consists of a four (4) day/three (3) night trip for the winner and one (1) guest to New York, NY. Prize includes round-trip economy class air transportation for the winner and their guest from a major airport near winner’s home to New York, NY, 4-day/3-night at least 3.5 star hotel accommodations (one room, double occupancy), meals for each winner and their guest (awarded in the form of prepaid gift cards equaling $400), a behind the scenes factory tour of Effy Jewelry’s midtown Manhattan factory, and $45,000 to spend at the Effy Hematian Boutique on 5th Avenue. The approximate retail value (“ARV”) of the Prize is $49,500.

Gift cards are subject to separate terms and conditions imposed by issuer.  Travel must be taken on dates designated by Sponsor. Travel is currently intended to take place in Summer 2025.  Dates of departure and return are subject to change at Sponsor’s sole discretion. Winner’s guest must be eighteen (18) years of age or older and must sign and return a Liability/Publicity Release prior to ticketing of the Prize. Winner and their guest must travel together on the same itinerary and possess all required travel documents, including valid photo ID. Air transportation tickets are non-refundable/non-transferable and may not be valid for upgrades and/or frequent flyer miles. All air transportation tickets are subject to the vagaries of flight variation, work stoppages and schedule or route changes. ARV may vary depending upon points of departure and destination and fare fluctuations. If the closest airport to a Prize winner’s home is in close enough proximity to Prize destination city so that, as Sponsor may determine in its sole discretion, a flight is unnecessary, such Prize winner will receive alternate transportation from the Sponsor with no further obligation to the winner. Prize winner will not receive cash or any other form of compensation if actual travel costs are less than the Prize ARV in these Official Rules. Sponsor reserves the right to structure the travel route and select hotels in its sole discretion. The winner may be required to provide a credit card at the time of hotel check-in. All expenses not specifically mentioned herein are not included as part of the Prize, and are solely the responsibility of the winner, including, but not limited to ground transportation, travel insurance, room service, bag check fees, parking fees, food, beverages, tips, gratuities, and service charges. If a Prize winner is unable to participate in the trip during the dates designated by Sponsor, the Prize will be forfeited in its entirety. The Sweepstakes Entities shall not be responsible for any cancellations, delays, diversions, substitutions, or any other act or omissions whatsoever by air carriers, hotel, venue operators, transportation companies, prize providers, or any other persons providing any Prize-related services or accommodations. No refund or compensation will be made in the event of the cancellation or delay of any transportation or missed Prize events, opportunities, or expenses incurred or change to any other Prize element as a consequence of delay or cancellation, except at the sole and absolute discretion of Sponsor. Prize is non-transferable, with no cash redemptions, equivalents, or substitutions except at Sponsor’s sole and absolute discretion. All Prize details not specified in these Official Rules will be determined in Sponsor’s sole and absolute discretion.

In the event a winner and/or their guest engages in behavior that (as determined by Sponsor in its sole and absolute discretion) is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the trip or other applicable experience, in whole or in part, including by sending such winner and/or their guest home with no further compensation. 

Decisions regarding the conduct of any winner and/or their guest in all aspects of their participation in the Prize event/activity will be in the sole discretion of Sponsor, or any of Sponsor’s representatives, and final and binding in all respects.

The Sweepstakes Entities make no warranties, and hereby disclaim any and all warranties, express or implied, concerning any Prize furnished by third parties in connection with the Sweepstakes. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND THE SWEEPSTAKES ENTITIES HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.


GENERAL PRIZE CONDITIONS:
Any potential Prize winner must execute and, for residents of the United States, have notarized an Affidavit (or Declaration, if a resident of Canada) of Eligibility, a Liability Release, and (where imposing such condition is legal) a Publicity Release (collectively, “Prize Claim Documents”). If any winner fails or refuses to sign and return all Prize Claim Documents within five (5) days of Prize notification (or a shorter time if required by exigencies), winner may be disqualified and an alternate winner may be selected. Prize winner shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the applicable Prize. Winner is solely responsible for any personal tax liability arising out of acceptance of the Prize. Each Prize winner will receive an IRS 1099 Form following receipt of the Prize.

GENERAL:
Acceptance of a Prize constitutes Prize winner’s permission for Sponsor and its designees to use Prize winner’s name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation, except where prohibited by law. Winner may, except where prohibited by law, be asked to participate in select publicity activities, as determined at the sole discretion of the Sweepstakes Entities.  Entrants agree that the Sweepstakes Entities shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Sweepstakes or any Sweepstakes-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any Prize.  Sponsor assumes no responsibility for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or postage-due submissions or Prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information.  Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Sweepstakes or the AMOE Website, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.  No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated multiple entries will be accepted.  Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein. In the event Sponsor is prevented from awarding the Prize or continuing with the Sweepstakes as contemplated herein by any event beyond its control, Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes.  If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winner in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination.  Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances.  These Official Rules cannot be modified or amended in any way except in a written document issued by a duly authorized representative of Sponsor.  The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

GOVERNING LAW:
ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE SWEEPSTAKES SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF NEW YORK WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS.

For Residents of Quebec: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of the Prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

PERSONAL INFORMATION:
Personal information will be used for the purposes of confirming the eligibility of an entrant, notifying a potential winner, awarding a Prize, reporting the winner information as required by law (as applicable), and any other purposes set forth herein.  All information collected from entrants is subject to Sponsor’s privacy policy, located at https://www.effyjewelry.com/pages/privacy-policy.  Your personal data will be treated in confidence and will not be disclosed to third parties. Personal data will not be stored or used for future marketing campaigns and will be deleted after the promotion and distribution of the Prize.
